These terms and conditions (the "Terms") govern your access to and use of Rebite App. By accessing or using the App, you are agreeing to these Terms and entering into a legally binding contract with Rebite. It is important that you read carefully and understand the Terms. Do not access or use App if you are unwilling or unable to be bound by the Terms. Any references to "you" and "your" refer to you, as a user of the App. References to "we" , "us" and "our" refer to Rebite.

1. CHANGES TO THE TERMS AND CONDITIONS

We may modify the Terms from time to time. When changes are made, we will update the date at the top of this page. You should revisit these Terms on a regular basis as revised versions will be binding on you. Any such modification will be effective upon our posting of new Terms. You understand and agree that your continued access to or use of the App after any posted modification to the Terms indicates your acceptance of the modification.

2. USING THE APP

A. Permission to Use the App : We grant you permission to use the App subject to the restrictions in these Terms. We may terminate your permission to use the App for any conduct that we consider to be inappropriate, or for your breach of these Terms, including the Restrictions listed in paragraph 4. Your use of the App is at your own risk.

B. App Availability : The App may be modified, updated at any time. You should update the App to get the latest version. But you don't have to update the App to get more items as we add the items in our database and the database is connected to the App.

C. User Accounts : You need to register yourself to browse or use our App. You need to have a Phone Number, Email ID while registering.

3. CONTENT

A. Responsibility for Your Content : You alone are responsible for the content of your messages, and you agree to indemnify and hold harmless Rebite and our agents with respect to any claim based upon the transmission of your message(s). We reserve the right to remove any messages for any or no reason whatsoever.

B. Ownership : All material on the App, including, but not limited to, text, data, graphics, logos, button icons, images, audio clips, video clips, links, digital downloads, data compilations, and software except the items' pictures and logos of the restaurants & stores is owned, purchased or controlled by, or licensed to Rebite and is protected by copyright, trademark, and other intellectual property rights. Material on the App is made available solely for your personal, non-commercial use and may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of Rebite in each instance.

4. RESTRICTIONS

A. You agree not to, and will not assist, encourage, or enable others to use the App to :
a. Send any message (via Contact Us) that is knowingly false and/or defamatory, inaccurate, abusive, vulgar, obscene, profane, hateful, harassing, sexually oriented, threatening, invasive of anyone's privacy, or otherwise in violation of any law;
b. Send any message in violation of a third party's copyright or other intellectual property or proprietary rights;
c. Send bulk emails, surveys, or other mass messaging whether commercial in nature or not;
d. Solicit, request or collect personal information for commercial or unlawful purposes;


B. You also agree not to, and will not assist, encourage, or enable others to :
a. Restrict or inhibit any other user from using and enjoying the App (for examples, by means of hacking or defacement);
b. Utilize any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape or index any portion of the App;
c. Remove or modify any copyright, trademark or other proprietary rights notice that appears on any portion of the App or on any materials printed or copied from the App;
d. Reformat or frame any portion of the App;
e. Remove, circumvent, disable, damage or otherwise interfere with any security-related features of the App, features that prevent or restrict the use or copying of App content or features that enforce limitations on the use of the App.


5. Additional Terms and Conditions for Users using the various services offered by Rebite:

1. ONLINE FOOD ORDERING:
a. Rebite provides online food ordering services by entering into contractual arrangements with Restaurants on a principal-to-principal basis for the purpose of listing their food and beverages for online ordering by the Users on the Rebite Platform ("Restaurant Partners"). The Users can access the list of food and beverages of the Restaurant Partners listed on the Rebite Platform and place online orders against the Restaurant Partners through Rebite, which the Restaurant Partner may or may not accept in its absolute discretion. Your request to order food and beverages from a Restaurant Partner by clicking on ‘Order Now’ tab on the Restaurant Partner page on the Rebite Platform shall constitute an unconditional and irrevocable authorization issued in favour of Rebite to place online orders for food and beverages against the Restaurant Partners on your behalf. An order, when placed on your behalf by Rebite and accepted by a Restaurant Partner, constitutes a separate contract of sale of goods under the Sale of Goods Act, 1930 and the Consumer Protection Act, 2019 or any successor legislations between the Restaurant Partner and the User, to which Rebite is not a party. Rebite is not a manufacturer, seller or distributor of food or beverages and merely places an order against the Restaurant Partners on behalf of the Users pursuant to the unconditional and irrevocable authority granted by the Users to Rebite, and facilitates the sale and purchase of food and beverages between Users and Restaurant Partners, under the contract for sale and purchase of food and beverages between the Users and Restaurant Partners.

b. Rebite shall not be liable for any acts or omissions on part of the Restaurant Partner including deficiency in service, wrong delivery of order, quality of food, time taken to prepare or deliver the order, etc.

c. For the users in India, it is hereby clarified by Rebite that the liability of any violation of the Food Safety and Standards Act, 2006 and applicable rules and regulations made thereunder shall solely rest with the sellers/brand owners, vendors, Restaurant Partners, importers or manufacturers of the food products or any Pre Packed Goods accordingly. For the purpose of clarity Pre-Packed Goods shall mean the food and beverages items which is placed in a package of any nature, in such a manner that the contents cannot be changed without tampering it and which is ready for sale to the customer or as may be defined under the Food Safety and Standards Act, 2006 from time to time.

d. Please note that some of the food may be suitable for certain ages only. You should check the dish you are ordering and read its description, if provided, prior to placing your order. Rebite shall not be liable in the event food ordered by you does not meet your dietary or any other requirements and/or restrictions.

e. While placing an order you shall be required to provide certain details, including without limitation, contact number and delivery address. You agree to take particular care when providing these details and warrant that these details are accurate and complete at the time of placing an Order. By providing these details, you express your acceptance to Rebite's terms and privacy policies.

f. You or any person instructed by you shall not resell food purchased via the Rebite Platform.

g. Delivery of an order placed by you through the Rebite Platform may either be undertaken directly by the Restaurant Partner against who you have placed an order, or facilitated by Rebite through third-party ("Restaurant Partners") who may be available to provide delivery services to you (“Delivery Partners”). In both these cases, Rebite is merely acting as an intermediary between you and the Delivery Partners, or you and the Restaurant Partners, as the case may be.

h. The acceptance by a Delivery Partner of undertaking delivery of your order shall constitute a contract of service under the Consumer Protection Act, 2019 or any successor legislations, between you and the Delivery Partner, to which Rebite is not a party. It is clarified that Rebite does not provide any delivery or logistics services and only enables the delivery of food and beverages ordered by the Users through the Rebite Platform by connecting the Users with the Delivery Partners or the Restaurant Partners, as the case may be.

i. Where Rebite is facilitating delivery of an order placed by you, Rebite shall not be liable for any acts or omissions on part of the Delivery Partner including deficiency in service, wrong delivery of order, time taken to deliver the order, order package tampering, etc.

j. You may be charged a delivery fee for delivery of your order by the Delivery Partner or the Restaurant Partner, as the Delivery Partner or the Restaurant Partner may determine ("Delivery Charges"). You agree that Rebite is authorized to collect, on behalf of the Restaurant Partner or the Delivery Partner, the Delivery Charges for the delivery service provided by the Restaurant Partner or the Delivery Partner, as the case may be. The Delivery Charges may vary from order to order, which may be determined on multiple factors which shall include but not be limited to order value, distance, demand during peak hours. Rebite will use reasonable efforts to inform you of the Delivery Charges that may apply to you, provided you will be responsible for Delivery Charges incurred for your order regardless of your awareness of such Delivery Charges.

k. All prices listed on the Rebite Platform are correct at the time of publication, and have been placed as received from the Restaurant after adding our charges. While we take great care to keep them up to date, the final price charged to you by the Restaurant may change at the time of delivery. In the event of a conflict between price on the Rebite Platform and price charged by the Restaurant, the price charged by the Restaurant shall be deemed to be the correct price except Delivery Charge of Rebite.

l. The total price for food ordered, including the Delivery Charges and other charges, will be displayed on the Rebite Platform when you place your order, which shall be rounded up to the nearest rupee. Users shall make full payment towards such food ordered via the Rebite Platform.

m. Any amount that may be charged to you by Rebite over and above the order value, shall be inclusive of applicable taxes.

n. Delivery periods/Pickup time quoted at the time of ordering are approximate only, and may vary. When You opt for Pickup, You shall be solely liable to ensure compliance with the conditions governing the Pickup at the time of placing the Order, and Rebite shall not be liable in any manner in this regard.


2. PROMO CODE:
a. Personal Promo code can only be used by You subject to such terms and conditions set forth by Rebite from time to time.
